A Scary Section of the Arizona
Personal Auto Insurance Policy
If you are involved in an auto accident or a situation presents where your Arizona insurance coverage
is going to have to respond, you as the insured, have contractual obligations to which you must adhere to
make sure that your insurance company provides you with the protection you need.
In terms of truly scary stuff, if you fail to comply with your specified duties, your insurance company has NO DUTY
TO PROVIDE AUTO INSURANCE COVERAGE FOR YOU.
Prompt Notification of Accident
You must notify your insurance company "promptly" of a potential claim including the particulars of the accident; how,
when and where including the names and addresses of any injured persons on witnesses.
The notice to the insurance company doesn't have to be immediate - but it must be "prompt". There is no real definition of
how many days constitute "prompt" but insurance companies don't like surprises and further dislike losing time or the
ability to mount a reasonable defense. It's the insurance company's money on the line. Make sure you are providing them with
the information they need to protect you.
Best advice, don't delay in letting the insurance company know that a potential claim is looming. The larger the potential
loss, the sooner you have to act. One of the things in life you don't want is certified mail from your own insurance
company that says "We are reserving our rights...and may deny coverage due to No Notice..."
It's an easy way out for the insurance company - don't give them this card to play.
Duties Required For Any Coverage Under Your Arizona Auto Insurance Policy
You as the insured have 5 duties that pertain to any and all personal auto insurance losses - these are non-negotiable
and certainly not optional:
-
Cooperate with your insurance company in the claim
-
Promptly send your insurance company any copies of notices or legal papers that pertain to the loss
-
Submit to physical exams by doctors your insurance company selects and pays for at their cost and submit
to any examination under oath
-
Authorize your insurance company to obtain medical reports and other necessary records
-
Submit proof of loss documentation when required by your insurance company
Duties Required for Collision & Comprehensive Coverage To Apply
If you are seeking coverage under the physical damage section of your auto insurance policy - either for collision
coverage or comprehensive - there are 2 other specific duties you have:
-
You must take reasonable steps to protect the car that was involved in the accident
-
If your vehicle is stolen you must also notify the police promptly so that they may file a report.
